Trademark is a mark symbolizing or involved a product. In realize,  a trademark is used to indicate that the product with trademark is diffirent from products with other trademarks for instance breeze, mama, red bull, etc.

The primary function of a trademark is to help consumers identify a product (as a commodity or as a service) of a particular company in order to distinguish it from products that have the same or similar capabilities provided by other companies. Once consumers are satisfied with that product, it is likely that the consumer will buy or use it in the future. So the label needs to be distinguished easily among the same product or the statue itself.

3. Some kinds of trademark in Thailand ?

There are some kinds of trademark in Thailand which includes service mark, certification mark, collective mark. First of all, service mark is known a mark symbolizing or involved with a service, a service mark is used to indicate that the sevice with such service mark is diffirent from services with other service marks as service marks of airlines, banks, hotel, etc. Secondly, a mark which the owner uses to symbolize or to associate with other product or service is classififed as a certification mark. In order to certify its quality, for instance “Halal”, “Nam Ram”, etc. Thirdly, collective mark is a trade or service mark used by the addiliated companies or private prganization.

4. Rule “first to file” in Thailand ?

If there are many people who apply for registration for the same or similary goods to the extent likely to confuse the goods of the same type or other goods but have the same attributes, the person filing the first application will be registered as the owner of the trademark.

The Trademark Registration authority shall notify all applicants, asking them for 90 days from the date of receipt of the notice to respond to the agreed view with the opinion that, the earliest applicant will be registered trademark.

If you do not agree that your trademark is the same or similar to another trademark is being applied for registration, the applicant may appeal to the trademark board within 90 days from the date of receipt of the notice.
