Malaysia is not a member state of the Madrid System, however, Malaysia has joined another treaty relating to industrial property, which is Paris Convention.

The Paris Convention, as revised at Stockholm on July 14, 1967, and amended on October 2, 1979, in accordance with Article 21(3) of the said Convention, entered into force, with respect to Malaysia, on the date indicated by the Government of Malaysia, that is, on January 1, 1989. The Paris Convention provides Malaysia trademark holders the priority right when filing trademark application in other member states. Trademark holders who has filed trademark application in Malaysia, shall enjoy the priority for their application in another member state of the Paris Convention, to be treated as filed on the filing date of the application in Malaysia (hereinafter referred to as “priority date”), as far as the contents were described in the application documents of the application in the first country.
